Media & Liability Release Form

Although we have taken the necessary precautions and safety measures, it is not possible to guarantee the safety of you and the minor participant(s) present under your responsibility. Better Than Reality is a simulation activity using Virtual Reality technologies with an increased risk. Participants can be injured if they stumble, bump into each other or other obstacles. We cannot exclude even more serious injuries.
We want to make you aware of this. By signing this statement, you make it clear that you are aware of this and that you understand, accept and agree to the conditions listed below.

I hereby declare that as a Future Of Mining attendee, I am aware, I understand and agree with the additional conditions below:

1. Acceptance terms & conditions

1.1. I understand that if I enrol in the activities of Better Than Reality Virtual Reality Training, I agree with the terms and conditions.
1.2. I understand that if I enrol on behalf of another person, that I and the other person both agree to the terms and conditions.

2. Risks

2.1. I understand that participation in the activities of Better Than Reality Virtual Reality Training, just like other physical (sports) activities, are strenuous, heavy, intensive, unknown and entails the risk of injury.

2.2. I am aware, understand and accept all risks, both known and unknown, regarding the use and participation in the activities of Better Than Reality Virtual Reality Training for myself and all participant(s) under my responsibility for whom I am signing.

3. Seizure & Motion-Sickness Warning

3.1. I understand and acknowledge that Virtual Reality experiences may cause or trigger:

• Dizziness, disorientation, and loss of balance

• Nausea and motion sickness

• Eye strain and visual disturbances

• Seizures or epileptic episodes (even in individuals with no prior history of epilepsy or seizures)

• Altered perception and spatial disorientation:

3.2. I acknowledge that I have been warned of these risks and accept full responsibility for any such occurrences.

3.3. I agree to immediately notify staff if I experience any discomfort and understand I should stop using the VR equipment immediately if symptoms occur.

4. Health & Hygiene

4.1. I declare that I am physically fit and not familiar with existing medical conditions such as heart or lung problems, epilepsy, high blood pressure, severe hearing loss and other medical conditions.

4.2. I declare that I have not had surgery recently and I have no history of problems with my ability to move.

4.3. I declare that I am not pregnant.

4.4. I confirm that I am currently free from symptoms of any contagious illness, including but not limited to: fever, persistent cough, loss of taste or smell, or any respiratory symptoms.

4.5. I acknowledge that VR headsets and equipment are shared between participants and that Better Than Reality implements cleaning protocols between uses. I accept any residual risk of disease transmission.

4.6. I understand that Better Than Reality Virtual Reality Training cannot provide medical advice, and I will seek professional medical advice in case of doubt.

4.7. By signing this declaration, I specifically authorise the provision of emergency medical treatment, and I accept the financial responsibility for such treatment, including the administration of emergency medical assistance and ambulance transport.

5. Equipment Damage Liability

5.1. I acknowledge that I will be responsible for any damage I cause to VR headsets, controllers, or any associated equipment due to misuse, negligence, or failure to follow instructions.

5.2. I agree to pay for the repair or replacement costs of any equipment damaged whilst under my care, at the current market value.

5.3. I understand that equipment must be handled with care and agree to follow all handling instructions provided by staff.

6. Liability of Better Than Reality PTY LTD

6.1. Better Than Reality PTY LTD, its licensors, employees, directors and agents are not liable to the customer, your dependents or legal representatives for personal injury or death suffered by the customer because the simulation activities were not supplied with due care and skill or were not reasonably fit for their purpose or because of the negligence, breach of contract, statute or statutory duty by Better Than Reality PTY LTD.

6.2. This release and waiver extends to and binds my heirs, executors, administrators, assigns, and next of kin.

7. Participation

7.1. I understand that participation is entirely voluntary and I have the right to stop the VR experience at any time without penalty.

7.2. I understand that I cannot be under the influence of medication, drugs or alcohol. I accept that non-compliance may result in Better Than Reality Virtual Reality Training refusing me participation in the VR activities.

7.3. I agree to abide by the rules and procedures of Better Than Reality Virtual Reality Training and to follow all directions of Better Than Reality Virtual Reality Training, including not using personal mobile phones during VR activities due to system interference it may cause to the VR network.

7.4. I agree not to record or copy any material from this training programme.

7.5. I confirm that I have received and understood all necessary safety instructions and orientation briefing on how to properly operate the VR equipment.

8. Participation of Minors

8.1. I declare that I am of age and that the minor participant(s) under my responsibility, for whom I also sign this declaration, have no health problems and/or restrictions that prevent them from participating in the activities of Better Than Reality Virtual Reality Training.

8.2. I understand that participants of 15 years or younger must be accompanied by a parent or guardian.

8.3. I promise that I will at all times supervise the minor participant(s) present under my responsibility and will act in collaboration with Better Than Reality Virtual Reality Training if circumstances so require.

9. Camera Surveillance & Media Release

9.1. I understand that CCTV is being conducted for my safety and the safety of Better Than Reality Virtual Reality Training personnel.
9.2. I agree that images and videos are made for safety, training and promotional purposes of myself and any enrolled participants for whom I am responsible.
9.3. I grant permission for any photographs or video footage of my participation (including reaction footage) to be used for future marketing, promotional materials, social media, or advertising purposes without compensation.

10. General Provisions

11.1. Severability: If any provision of this agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby, and such provisions shall remain in full force and effect.
11.2. Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of Western Australia, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Western Australia.
11.3. Entire Agreement: This document constitutes the entire agreement between the parties and supersedes all prior understandings or agreements relating to the subject matter herein.
I accept all risks associated with participation in the activities of Better Than Reality Virtual Reality Training and I explicitly indemnify Better Than Reality PTY LTD and its affiliated third parties, including; its licensors, undertakers, instructors, managers, directors, representatives, employees and the owner of the property in which the Better Than Reality Virtual Reality Training activities take place, manufacturers and installers of the equipment of all Better Than Reality Virtual Reality Training and associated other activities; liabilities, claims, demands or other proceedings that may arise from (permanent) injury or death or to any damage or loss caused to my property during participation in any part of the activities of Better Than Reality Virtual Reality Training or related other activities for myself or for the minor participant (s) present under my responsibility for which I am signing.
By signing below, I acknowledge that I have read and understood this Liability Waiver and Release Form and voluntarily agree to its terms.
